Cancellation Policy

Samadhan & Co. (Partners & Consultants) (hereinafter referred to as the “Firm”), owns and operates the interactive website samadhanco.in (hereinafter referred to as “Platform”). The same is also depicted by logo which reads as ‘S & Co’ with the specific design and format as shown on the website. For this Cancellation and Refund Policy (hereinafter referred as “Policy”), the use of terms like we", "us" and "ours" refers to the "Firm" and the terms "you", "your", "yours" and "user" refers to any "natural or legal person" who browses through the Platform or avails the Services offered through the Platform. By accessing this Platform, you acknowledge that you have read and understood the terms provided under this Policy and agree to be bound by them. However, if you disagree, kindly exit from the Platform immediately as your continued access shall be construed as an acceptance of this Policy. We respect and value our clients and believe in providing them with maximum service satisfaction. However, in case you are not happy or satisfied with the services, kindly write to us and we will ensure to rectify the issue or make refunds of the order placed. The cancellation of the orders placed on the Platform shall be governed by this Policy.

FIRM RESERVES THE RIGHT TO REFUSE/CANCEL ANY RIGHTS

 

The Firm at its sole discretion may cancel any Service(s). The Firm reserves the right to refuse/cancel any Services. The Firm at its sole discretion may cancel any Service(s), if:

  1. It suspects a fraudulent transaction, or

  2. It suspects a customer has undertaken a transaction that is not in accordance with the Terms of Use or

  3. Unavailability of staff.

 

APPLICABILITY OF POLICY

 

By agreeing to use the Platform and/or placing a request for the services on the Platform, you agree to bound by the terms contained in this Policy without any modification. If you do not agree to the terms contained in this Policy, you are advised not to transact on the Platform. 

 

The terms of the Policy shall be applicable on both the categories of customers of the Platform, that are:

  1. Pay as you go customer

  2. Subscribed members of the platform

Please note that we may from time to time change the terms of the Policy that govern your refund, and cancellation of an order for the services on the Platform. Every time you wish to use the Platform, please check the Policy to ensure you understand the terms and conditions that apply at that time.  

 

CANCELLATION AND REFUND

 

If you wish to cancel any order under the services provided by the Platform, the same shall be initiated within a period of 1 hour (one Hour) from placing the order. However, we will initiate the refund only up to the amount paid for the Services in your designated account within a period of 7 (seven) working days.

REFUNDS OTHER THAN FOR CANCELLATION

 

  1. Any payments made by you on this Platform are in lieu of services (hereinafter referred as the “Service Fee”) being rendered through the Platform. Once the Service Fee has been paid and the cancellation period has lapsed, wherever applicable, the work assigned to our legal experts who invest their time and hard work to provide you with the best possible services which are non-refundable in nature. Therefore, the Service Fee paid by you for availing services is non-refundable due to resources and man-hour spent on delivering of services. In addition to the Service Fee, any other charges like taxes, filing fees or Government charges paid by you are non-refundable in nature. Under any circumstances, if at all the Firm is liable for any refunds, the same shall not exceed the Service Fee paid by you for any service after deducting all the necessary taxes.

MANNER OF RASIING CANCELLATION/REFUND REQUEST

 

Any request for cancellation or refund shall be raised by writing an email to us at nivax@samadhanco.in within the stipulated timelines mentioned in the Policy. The email for raising cancellation or refund requests shall contain your name, order number, service particulars along with a valid reason for cancellation or refund without which no cancellation or refund request shall be entertained.

If we are satisfied with the reason for cancellation or refund and believe that the same cannot be resolved by our team, we will initiate the refund (after deducting all the necessary taxes) in your designated account within a period of 7 (seven) working days.

CHANGES IN SERVICES

 

Once the payment for any of the Services has been made, the same cannot be changed. However, it can only be changed if the user avails a service higher in charge than the earlier one. The Firm only accepts requests for amendments in the documents delivered under Custom Agreements up to 2 times from the date of delivery. With the additional caveat that the requested changes will only be implemented if the nature of the document’s transaction has not changed entirely.

 

STANDARD PRICING

 

We have a standard pricing policy for services with no additional service charges under any circumstances. The Firm reserves the right to revise the Service Fee payable for services from time to time and the same shall become effective as and when it is updated on the Platform. The Service Fee so revised shall be the standard pricing with no additional service charges other than as displayed on the Platform. The applicable taxes and government charges, however, may apply. The standard pricing policy shall not be applicable to an increase in the total amount payable due to an increase in applicable taxes or other government charges.

 

FORCE MAJEURE

 

We shall not be under any liability for failure to perform any of our rights and obligations under this Terms of Use, if such acts of failure are due to any act of God, fire, earthquake, floods or any natural calamities or transportation embargoes, riots, pandemic, violence, acts of terrorists, lockdown, state enemies or any other reasons or circumstances beyond our control.
